El gerente de Lauara Europea, Enrique Ros, manifestaba que tras la reunión con el concejal de Urbanismo Jesús Tébar, éste ha sido receptivo a la petición que se le formula, esperando esclarecer el asunto, «por lo que hemos tomado la decisión de no acudir con los trabajadores a la urbanización en unos días hasta recibir contestación por parte del Ayuntamiento, por lo que estaremos a la espera de conocer la respuesta municipal. En caso de dilatarse -añade- nuestra postura será la de tratar de acelerar los trámites, porque son muchas las familias que esperan entrar al tajo».

La empresa pide que la Policía Local la auxilie para entrar a Las Higuericas

El representante de Cleyton Ges presentó un escrito en el que dice al Ayuntamiento que otra sociedad asume la obra de urbanización

En la mañana de ayer, Pedro Antonio Jiménez Peñalver, en representación de la empresa Cleyton Ges, presentó en el Ayuntamiento un escrito recordando el convenio de planteamiento y desarrollo para el sector de la urbanización Las Higuericas.

Mantuvo también una reunión con el concejal de Urbanismo, Jesús Tébar.

Convenio

Recuerda el escrito que con fecha 29 de septiembre de 2005, se firmó entre el Ayuntamiento y la citada mercantil, el convenio 'Programa de actuación urbanizadora Las Higuericas, mediante el cual quedaba concedida la posición de agente urbanizador, con todas las obligaciones y derechos que ello conlleva, a la mercantil Cleyton Ges. En la mañana de ayer, los trabajadores acudieron de nuevo a las puertas de la urbanización, donde los vigilantes les impidieron de nuevo (como ya sucedió el día anterior) el paso.

El escrito presentado argumenta que «como consecuencia de una actuación de carácter jurídico, que afectó a la viabilidad del proyecto, se paralizaron las obras hasta la definitiva resolución del conflicto suscitado, mediante sentencia del Tribunal Superior de Justicia de Albacete en la sala de lo contencioso administrativo, en enero del pasado año».

Dicha actuación, sigue indicando el escrito, «afectó en tal medida a la mercantil, que esta no pudo hacer frente a sus obligaciones derivadas de los citados convenios, por lo que una vez iniciados los trámites oportunos para la adjudicación de la propiedad de los terrenos a favor de Caja de Ahorros del Mediterráneo (CAM) por la vía de ejecución hipotecaria, el juzgado de primera instancia nº 1 de Hellín, dictó providencia a favor de la entidad hipotecaria».

La decisión concedía a la entidad financiera «la posesión interina de las parcelas de uso lucrativo destinadas a viviendas resultantes del proyecto».

En tal sentido, la empresa instó -asegura en el documento presentado al Ayuntamiento hellinero- reiteradamente al juzgado de primera instancia de Hellín para que este reconociera el derecho que ostenta Cleyton Ges derivado de su posición de agente urbanizador (distinto -explica la sociedad- del derivado de la propiedad de las parcelas), para que le reconociera el derecho de acceso a las obras, para su terminación y la posterior constitución de entidad de conservación, cumpliéndose, en tal caso, entiende la empresa, los acuerdos celebrados con el ayuntamiento.

Contrato

El escrito contempla que «ante la falta de resolución por parte del citado juzgado, Cleyton Ges celebra el pasado 7 de julio un contrato de arrendamiento de obra con la sociedad mercantil Lauara Europea SL, elevado a público el 1 de septiembre, que del mismo modo fue presentado ante el registro de entrada del Ayuntamiento el cual hoy tengo el privilegio de volver a referirme».

Mediante dicho acuerdo de voluntades, Lauara Europea asume todas las obligaciones contraídas por Cleyton Ges, asumiendo por su cuenta y riesgo todas las obras que resten para la conclusión del proyecto.

Todo ello, siempre según indicó la empresa, en base a la potestad que el convenio urbanístico de planteamiento y desarrollo, aún en vigor, confiere a Cleyton Ges, en su cláusula segunda, así como en el articulo 117.2 de la Lotau.

«Trabajadores repelidos»

Basándose en estos hechos, el día 6 de septiembre se persona la sociedad Lauara Europea, representada por el administrador, en las obras del sector, con varios trabajadores y maquinaria pata tomar posesión de las obras, así como para el inicio de las mismas.

Recuerdan también que los trabajadores de la mercantil «fueron repelidos por la empresa encargada de la seguridad de las viviendas, instadas por sus superiores, que negaron el acceso a los empleados de la mercantil llegando incluso a interponer denuncia contra los mismos».

En su escrito, la empresa solicita «la intervención de la concejalía de Urbanismo mediante el auxilio de la Policía Local, para remover todos los obstáculos que impiden el cumplimiento de las obligaciones derivadas de los citados convenios».

The company calls the local police for help in entering Las Higuericas

The decision granted to the bank was "the interim possession of plots for residential use or for profit from the project."

In this regard, urges the company in the said document, presented to the City Council, for the court of first instance in Hellín for recognition of the right which Cleyton GES SL holds as derived from its development agent position (non-explains-the society derived from the ownership of the plots), so that you recognize the right of access to works, for completion and the subsequent establishment of conservation entity, fulfilling, in this case, the companies agreements with the city.

Contract

The document states that "in the absence of resolution by the court, Cleyton GES SL signed on 7 July a contract to lease the work to Lauara Europea SL, which was notified to the public on September 1 and likewise was presented to the City Council"

Under this agreement, Lauara Europea SL assumes all obligations of Cleyton GES SL, assuming at its own risk all the work remaining to complete the project.

This, again according to the company is based on the power which the planning agreement for planning and development, still in force, gives Cleyton GES SL, in its second clause, as in Article 117.2 of the LOTAU.

"Workers 'repelled'

On the 6th of September based on these facts, Lauara Europea SL, represented by the administrator with several workers and machinery took possession of the works, and for starting them.

Remember also that the commercial workers "were beaten back by the company responsible for the safety of homes, urged by his superiors, who denied access to commercial employees even to lodge a complaint against them."

El escrito que la empresa ha presentado en el Ayuntamiento de Hellín el 1 de septiembre dice: «La empresa Lauara Europea SL, solicita la sustitución de la obligación para la terminación de la obra del complejo las Higuericas, según la autorización de la cláusula segunda del convenio concertado con el Ayuntamiento de fecha 19 noviembre del 2004 y desarrollado por el convenio de gestión urbanística del 29 de septiembre del 2005.

Solicita que se tenga por presentado el escrito dándose por notificado la adopción al citado contrato entre mi representada y la mercantil Lauara Europea SL».

Intento frustrado de retomar las obras en Las Higuericas

Una empresa llevó a sus trabajadores a la urbanización, pero la seguridad contratada por la CAM les impidió el paso

El caso de la urbanización de Las Higuericas vivió ayer un episodio insólito, cuando un grupo de trabajadores no pudo entrar al recinto -cuyas obras están abandonadas hace meses- al impedírselo la vigilancia que hay en la puerta.

Ante la entrada hubo momentos de tensión. Por un lado estaban el empresario que había llevado a estos trabajadores, Enrique Ros, y el empresario Pedro Jiménez, de la promotora de la urbanización, Cleyton Ges, que los había contratado. Por otro, representantes de la CAM, y, al parecer, de la filial de gestión de inmuebles Aliancia Zero, que mantuvieron la prohibición de entrar a la urbanización.

La seguridad que vigila la Urbanización Las Higuericas, al parecer puesta por la CAM y Aliancia Zero, impidió la entrada al recinto a los trabajadores, que incluso habían acudido con maquinaria para realizar trabajos de urbanización.

Estos trabajadores -una veintena- y empresarios se habían personado a las puertas del complejo a las ocho de la mañana. Los vigilantes les informaron que tenían instrucciones de no dejar pasar a nadie no autorizado.

Ante la situación encontrada, Enrique Ros y Pedro Jiménez, sobre las 12 horas se desplazaron a Hellín, poniendo una denuncia, manifestando los hechos, en el Cuartel de la Guardia Civil. Explicaron que «tenemos comunicado al Ayuntamiento de Hellín la intención de acabar las obras. La obra está contratada desde el 7 de julio pasado, para terminar la urbanización».

Pedro Jiménez, que se identificó como actual propietario de la urbanización, quiso dejar claro que no está en paradero desconocido (en referencia a las resoluciones judiciales que afirman esa situación en relación a la empresa Cleyton Ges): «yo soy el actual propietario de esta obra y nadie me puede impedir que yo entre a realizar el trabajo que quiero terminar».

Añadió que «la empresa no tiene culpa de nada, todo ha sido tema político; sabemos las circunstancias que hay en la calle y que cuesta mucho trabajo y dinero poner esto de nuevo en marcha; pero quiero terminarla, cumplir el compromiso con la administración, con el Ayuntamiento y con la sociedad».

Sobre quién dificulta que pueda proseguir, dijo: «La CAM tiene iniciado, por desacuerdo con la promotora Cleyton Ges, su procedimiento de ejecución. Para evitar los expolios cogió la custodia del complejo; pero una cosa es la custodia de bienes y otra cosa es que cuestione el acceso, y Cleyton Ges es el propietario de esto y lo que quiere es terminar la urbanización».

Pedro Jiménez agregó: «estamos viendo esto con muchos problemas gracias a la CAM, lo que yo deseo es reanudar las obras, porque todos los días tenemos juicios y querellas; y quiero decir muy claro que no estoy desaparecido».

Recordaba que están finalizadas 70 chalets, en los que -afirmó- se puede entrar a vivir, de las más de 600 que contempla el proyecto final, (la mayoría aún no se han realizado).

Para Jiménez, el proyecto no está parado, ya que dijo que piensa seguir hasta el final para esclarecer lo que le está pasando, por las muchas trabas -declaró- «que me están poniendo, sin saber por qué, por eso si no nos dejan ir por las buenas, lo vamos a hacer por las malas, porque después de dos años, yo quiero cumplir con quien ha comprado una casa y tengo invertido todo lo mío dentro».

Pasadas las 14 horas hizo su aparición el representante de la CAM -o de Aliancia Zero -, entrevistándose con los miembros de la seguridad, por espacio de unos 30 minutos. Cuando accedió a la puerta, le impidió la entrada a Pedro Jiménez, teniendo la charla, un tanto tensa, en las inmediaciones.

El representante de la entidad de ahorro dijo, que no se les podía facilitar el paso a la urbanización, argumentando que serán los abogados los que diriman el tema, porque -añadía- mientras no haya novedades, a estos señores les seguirán impidiendo el paso».

UNSUCCESSFUL ATTEMPT TO RESTART THE WORKS IN LAS HIGUERICAS

The case of the Las Higuericas urbanization, whose works have been abandoned for months, experienced yesterday an unusual episode, when a group of workers could not enter the compound due to the security guards at the gate.

In the entrance there were moments of tension. On one side were the businessman who had hired these workers, Enrique Ros, and Pedro Jiménez from the promoter of the development, Cleyton GES SL.  On the other side were representatives of CAM Bank, and apparently, the property management subsidiary Aliancia Zero, who maintained the ban on entering the development.

The security guards at Urbanization Las Higuericas, apparently put in place by CAM and Aliancia Zero, prevented the workers, who had even gone with machinery for development work, from entering the premises.

These 20 workers and entrepreneurs were at the gates of the urbanization at eight o'clock. The guards told them they had instructions not to let anyone in who was not authorized.

Due to the situation encountered, Enrique Ros and Pedro Jiménez, travelled to Hellin at 12 O’clock and made a complaint, stating the facts, at the Police Station. They explained that "we have informed the City Council's of our intention to complete the work at Las Higuericas. The work is contracted from July 7 to complete the urbanization"

Pedro Jiménez, who identified himself as the current owner of the development, wanted to make clear that he is not missing or of unknown whereabouts (as stated in reference to many judicial decisions affirming the position in relation to the company Cleyton GES SL): "I am the current owner of the work and nobody can stop me from doing the work I want to finish"

He added that ”the company is not guilty of anything, everything has been a political issue; We know the financial circumstances that exist in the street and the hard time of putting this back on track; but I want to finish it, fulfilling the commitment with the Administration, the City Council and society”

Regarding who makes it difficult to continue, he said: "CAM has initiated an enforcement procedure and disagreement with the promoter Cleyton GES SL. To avoid looting and damage it took custody of the complex, but one thing is the custodian of goods and another thing is the question of access, and Cleyton GES SL owns it and what it wants is to finish the development"

Pedro Jiménez added: “we have many problems thanks to CAM, and what I wish is to resume the works, because every day we have Lawsuits and complaints; and I want to say very clearly that I am not missing”

He mentioned that 70 houses are completed, which, he says, you can go to live in.  The final project includes more than 600 houses (most have not yet been built).

For Jiménez, the project is not stopped, as he said he plans to continue until the end to clarify what is happening, and of the many obstacles he declared, "I don’t know why they are putting me through this, so if you do not leave us to do it the good way, we'll do it the hard way, because after two years, I have invested everything I have in this and I want to meet those who have bought a house"

After 2pm the representative of CAM - Aliancia Zero – made an appearance and then talked with members of the security for about 30 minutes. When Pedro Jiménez came to the gate he was prevented from entering and a tense conversation took place in the area.

The representative of CAM said, that it was not possible to facilitate entry to the urbanization, arguing that it will be the lawyers who will resolve the issue, because - he added - while there is no new information, they will keep on preventing these gentlemen from entering.

El promotor de Las Higuericas, buscado por el Ayuntamiento

El Ayuntamiento de Hellín ha pasado a engrosar la lista de quienes consideran que no es posible localizar a la promotora de la urbanización Las Higuericas. Desde hace meses, diversos juzgados de las provincias de Albacete y Murcia han anunciado sus decisiones respecto a esta empresa, Cleyton Ges, en los boletines oficiales al comprobar que se encuentra «en paradero desconocido».

Ahora ha sido el propio Ayuntamiento de Hellín el que se ha visto obligado a recurrir al Boletín Oficial para comunicar a Cleyton Ges dos decisiones, relacionadas una con los impuestos por el incremento del valor de los terrenos de la frustrada urbanización, y otra, una sanción basada en el mismo asunto.

Se le notifica por esta vía la resolución del alcalde, Diego García, ya que «habiéndose intentado por parte de la Inspección Municipal de Tributos» la notificación de estas resoluciones, no ha sido posible practicarla; no se le encuentra.

Las Higuericas amargan el 'viaje inmobiliario' de José Blanco a Gran Bretaña

El fiasco de la macrourbanización de Las Higuericas, en Hellín, ha amargado en parte la visita que el ministro de Fomento, José Blanco, ha hecho a Gran Bretaña para promover la venta de viviendas en España para ciudadanos británicos.

Ante la embajada española en Londres, representantes del Fincaparks Action Group (que agrupa a personas afectadas por este asunto) intentaron reunirse con el ministro. Se les impidió el paso, pero su situación ha provocado, junto a la de otros afectados por casos parecidos y por la Ley de Costas, una enorme repercusión en los medios de comunicación ingleses.

En ellos, desde la BBC al Financial Times, The Telegraph y el Guardian, se ha puesto de relieve la situación de decenas de miles de británicos que invirtieron en España -se cita el caso de Las Higuericas- y que ahora no tienen ni el dinero que invirtieron ni la casa que adquirieron. Un juzgado social declara insolvente a la promotora de Las Higuericas

La macrourbanización sigue abandonada desde hace meses, mientras la empresa se mantiene «en paradero desconocido»

La empresa promotora de la inacabada macrourbanización hellinera de Las Higuericas ha sido declarada insolvente. El Boletín Oficial del Registro Mercantil publicó, el pasado 21 de septiembre, la decisión judicial que considera a la firma Cleyton Ges incapaz de hacer frente a sus deudas.

La declaración oficial de insolvencia de la promotora (que empezó la construcción de una promoción de más de seiscientos chalets en un paraje aislado, entre la Sierra de los Donceles y el embalse de Camarillas) es consecuencia de la decisión del Juzgado de lo Social número 2 de Albacete, uno de los que llevan causas contra la sociedad relacionadas con reclamaciones de sus ex empleados.

En concreto, el auto judicial en el que se basa esa declaración supone un paso más en la serie de reclamaciones y decisiones de ejecución y embargos que se han ido acumulando contra Cleyton Ges desde que, hace ahora un año, comunicó su decisión de abandonar el proyecto por falta de viabilidad económica. Ahora, el juzgado ha comprobado, al intentar ejecutar los bienes de Cleyton Ges para hacer frente al pago de 11.800 euros para uno de los trabajadores, que «las actuaciones y averiguaciones practicadas» no han resultado positivas; es decir, que no se han encontrado bienes que ejecutar, por lo que se acuerda dictar la insolvencia, que tiene carácter provisional.

La decisión se publicó en el Boletín Oficial de la Provincia, ya que Cleyton Ges sigue «en ignorado paradero», según recoge el auto judicial. También siguen otras actuaciones en los juzgados contra esta empresa, tanto en tribunales de Albacete como en los de Murcia.

Embargos

Recientemente, el 24 de septiembre, el Juzgado de lo Social número 1 de Murcia también acordaba el embargo preventivo de los bienes de Cleyton Ges, por otra reclamación laboral, en este caso de unos 52.000 euros.

Por otra parte, un grupo de afectados por la paralización del proyecto, en su mayoría de nacionalidad británica, anunciaron el pasado verano su decisión de emprender acciones legales para reclamar la devolución del dinero que aportaron, que estiman en más de dos millones de euros, ya que no han recibido sus viviendas.

The company behind the unfinished macrourbanización in Hellin, Las Higuericas has been declared insolvent.

The Trade Register Gazette published on 21 September 2010 includes the court decision which considers the firm Cleyton GES SL is unable to pay its debts.

The official declaration of insolvency of the developer (which began construction on a development of over six hundred houses in an isolated spot, between the Sierra de los Donceles and Camarillas Reservoir) is a consequence of the decision of the Labour Court No. 2 in Albacete, one of the leading cases against the company related to claims of its former employees.

Concluye la fase de prueba en la denuncia contra la urbanización de Las Higuericas

Dos de las denuncias que se presentaron contra la macrourbanización de Las Higuericas, en Hellín, siguen adelante en los juzgados, Se trata de las que presentó Ecologistas en Acción, por un lado contra el procedimiento de recalificación del suelo, y por otro entra la resolución del delegado de Medio Ambiente que determinó que este proyecto no necesitaba un procedimiento reglado de impacto ambiental.

El proceso sobre la recalificación del suelo va más lento, porque también se trata de un aspecto más complejo.

En cambio, el procedimiento que se refiere a la resolución sobre el impacto ambiental va más avanzado, según anunció ayer José Julio del Olmo, de Ecologistas en Acción.

Según indicó, ha terminado ya la fase de prueba, en la que las partes aportan la documentación o testimonios que consideran pertinentes, y pasa ya a la de conclusiones, por lo que es previsible que pueda resolverse este asunto en el juzgado para el próximo otoño, los meses de octubre o noviembre.

La oposición reiteró que la obra no la paró ningún juzgado, sino la ruinosa gestión de una empresa «que está en busca y captura»

La sentencia sobre la macrourbanización abrió un agrio debate en Hellín

La segunda sesión plenaria del año del Ayuntamiento hellinero se alargó tres horas y media.

El tema de mayor duración (una hora y quince minutos), fue la sentencia del TSJ, sobre la resolución del complejo Las Higuericas.

El alcalde ordenó al secretario que diera cuenta del contenido de la resolución, que da la razón -dijo- al Ayuntamiento y que declara sujetas a la legalidad las obras de urbanización y las licencias de las primeras 105 viviendas. La sentencia -insistió el alcalde-, declara la legalidad absoluta del proyecto.

El concejal socialista Ramón García acusó al Partido Popular de la situación económica del Ayuntamiento a consecuencia de este proyecto, por cuya paralización ha dejado de ingresar -indicó- 12 millones de Euros. García acusó a los populares de causar el fracaso de esta macrourbanización, y de haber metido Hellín en el mapa nacional de la corrupción con «burdas mentiras y patrañas».

Acusó igualmente a los populares de judicializar la vida política con denuncias que finalmente pierden. El alcalde reiteró que los tribunales han dado la razón a personas comprometidas con Hellín y han dejado claras las cosas. Rosa Pilar Sáez, del PP, aseguró que se había pasado de «dar cuenta» a insultar a su partido, haciéndolo «con un discurso que se ha traído escrito, por un hecho que denunciamos para proteger el medio ambiente de nuestro municipio».

El portavoz del PP Antonio Callejas acusó al alcalde y a Ramón García de decir verdades a medias sobre la sentencia, y recordó que la vía penal no la abrió el PP, sino un grupo ecologista.

Callejas indicó que hace más de cinco años de planteó la posible ilegalidad de la urbanización que se pretendía hacer: «la denuncia que pusimos la hicimos por los intereses de Hellín y lo volveríamos a hacer; abrimos la vía contencioso administrativa, no la penal como usted ha querido hacer ver».

El concejal del PP matizaba que «la obra no la paró ni el juzgado ni los concejales del PP. La paró el 19 de febrero del 2009 una empresa insolvente que está en busca y captura. La están buscando los trabajadores, los contratistas, Dragados, el banco».

«No es la empresa -añadió- un modelo empresarial; paró por insolvencia manifiesta y porque ha quebrado el modelo de urbanismo salvaje que en este Ayuntamiento se ha potenciado». Preguntaba si el PP también tiene la culpa de que haya fracaso el proyecto de las Dehesillas que también debe al Ayuntamiento nueve millones de Euros.

El concejal de IU Francisco Javier Morcillo, sobre el punto dijo que en otras ocasiones en los puntos de dar cuenta no se permitió debatir. Tras indicar que respeta la sentencia, aclaró que «se tienen que aclarar algunas cosas, como que se diga por que el Ayuntamiento ha perdido 12 millones de Euros. La promotora Cleyton Ges -añadió- paró las obras porque dijo que la urbanización no era viable por la situación de crisis en estos momentos».

Muchas deudas
 

Añadió Morcillo que la promotora tenía un alto riesgo, y un capital social de solo tres mil Euros: «nos preocupaba y nos preocupa que en estos momentos está en paradero desconocido; y los pintores, carpinteros, albañiles y otras muchas empresas que le trabajaron están sin cobrar, porque fueron despedidos antes de paralizar las obras».

Se preguntó «que opina la promotora de la sentencia, porque la empresa nunca dio la cara y tiene grandes deudas con los trabajadores. Es importante -apostillaba el concejal de IU- saber si es verdad que al Ayuntamiento le debe 12 millones para que se pueda ejecutar».

Tras el largo debate, se trataron otros asuntos, como adjudicación de parcelas en el Polígono La Fuente, solicitud de prórroga por cinco meses de la urbanización Tenerías, o condiciones para adjudicar un quiosco en calle Juan Ramón Jiménez.

Otro apartado del boletín de IU recuerda la situación en la que se encuentra el complejo urbanístico Las Higuericas, diciendo que «veníamos denunciando la barbaridad que suponía el proyecto, así como las consecuencias medioambientales por el daño imposible de reparar que causaba sobre un lugar de singular interés ecológico».

Añaden que «desde que la empresa Cleyton Ges llegara a Hellín repartiendo dinero a distintas asociaciones en un claro acto de compra de voluntades, ha contando con el apoyo incondicional de las administraciones, tanto regional como municipal, hasta el punto de aprobar el proyecto sin el estudio de impacto medioambiental como es preceptivo en una zona de la Red Natura 2000».

Morcillo recordó que la promotora Cleyton Ges anunció a los compradores que abandona definitivamente el proyecto por considerarlo financieramente inviable.

El PP afirma que «si hay un derrotado en Las Higuericas ha sido el medio ambiente»

Antonio Callejas, concejal hellinero del Partido Popular, ha salido al paso de las manifestaciones vertidas por el alcalde Diego García Caro en contra del grupo de concejales del PP que en su día denunciaron el cambio de utilidad del paraje de Las Higuericas, donde se empezó a construir una macrourbanización, ahora abandonada.

Callejas comenzó diciendo que la sentencia de Las Higuericas «no es una derrota del PP; Las Higuericas son una derrota del medio ambiente y del sentido común».

Aseguró que «las triquiñuelas legales de Barreda, anulan por la puerta de atrás la protección que él mismo impuso a aquellos terrenos». Esto es una prueba más -añade- de la facilidad del presidente castellano manchego de mover las normas urbanísticas como si la Región fuera su cortijo.

Callejas siguió diciendo que los problemas legales de Las Higuericas «no los ha solucionado el juzgado, los ha solucionado la desvergüenza de Barreda, que desprotege un día lo que protege el día anterior, apañando y amañando las normas y leyes para, como en este caso, salvar los muebles de una aberración urbanística que implica a su gobierno y al alcalde de Hellín».

De por que presentar la denuncia en su día en los juzgados, Callejas dice que el PP ha sido el único partido que ha luchado contra la aberración urbanística medioambiental que supone la urbanización de Las Higuericas.

«Nosotros en su día, -sigue diciendo- cumplimos con la labor de control y fiscalización de la acción del gobierno municipal, tal y como hacemos siempre desde que los ciudadanos nos encomendaron este cometido en las urnas».

El grupo municipal del PP -añade Callejas- «hizo lo que tuvo que hacer en defensa de lo que consideró más conveniente para el municipio; actuaciones, que, sin lugar a dudas, volveríamos a entablar de producirse hoy.

Oposición

Callejas manifestaba que su grupo se limitó a velar por el cumplimiento de las protecciones medioambientales que el propio gobierno de Castilla la Mancha ordenó para los terrenos donde de pretendía construir esta urbanización.

De lo manifestado por el alcalde contra el PP en rueda de prensa, Callejas dice: «es la misma cantinela de siempre por las supuestas empresas que dejan de venir a Hellín, nosotros nunca nos hemos opuestos a que a Hellín acudan empresas. Lo que le pasa al señor García Caro, es que dice que la culpa de todo en Hellín la tiene el PP».

Agregó que «en las Higuericas la paralización no es por las sentencias, es porque la empresa, o quienes la representan, están en paradero desconocido, buscados por los juzgados». «En este asunto -añadió- existen muchas cosas más que se ocultan y ahora llega una sentencia, la cual respetamos, pero no compartimos». Insistió en que todo se ha hecho desde el Gobierno regional para no aportar un documento ambiental muy problemático, «que podía poner a mucha gente en peligro».

Se refería a la falta de un informe de la Junta, requerido por el juzgado en la sentencia anterior para la legalización de las licencias, sobre la protección medioambiental del paraje.

"This," the mayor said at a news conference, is easy to explain, that licenses granted for the works of urbanization and housing, were granted following the strictest legality.

Elections

Caro Garcia added that "due to its significance, this has been the biggest judicial rebuke ever received the People's Party in Hellin, Albacete and Castilla-La Mancha. The decision of the Appeal Case No. 17 of 43/09 Appeals said that "we consider the appeals lodged by Cleyton GES and the city of Hellin, against the decision dated November 11, 2008 issued by the Court Administrative Litigation 2 of Albacete in the 183/07 standard procedure.

The decision invalidates and nullifies the ruling, and dismissed the appeal being filed against an administrative decision of the Local Government Board Hellín City Council of 15 March 2007, granting planning permission No 251/06 to Cleyton Ges.
 
Humiliation

According to this statement, the mayor and senator Diego Garcia Caro has been a victim in this case of "a chain of assemblies, intimidation, insults, disqualifications and humiliation-personally and politically, of those, one every other day also , offered us and offer us inhuman and degrading ".

Ghost town

In the midst of an untouched landscape in central Spain British promoters wanted to build a village with 600 residential units. But now everything stands still.

The idyll is deceptive: 50 townhouses in Finca Parcs in Spain are completed. But the urbanisation is fenced and uninhabited.

A small road leads south overland to the Spanish town of Hellin towards the village Agramon. After about two miles further south on the right side - in the midst of a pristine landscape - you suddenly see a major redevelopment. A billboard, which is fixed on a several-meter-high pillars, looks faded. At the bottom of a scrap of an advertising banner can be seen: "The Real Spain" - the real Spain - is the slogan.

Scar on the landscape

This advertising slogan has now acquired a double meaning: there is no construction equipment visible on the site. The contractors have withdrawn their machines in February of last year. Since then everything stops. Many buyers have suffered a total loss.

It is the nightmare of every landscape protector. The superstructure is like a ghost town. Almost 50 townhouses have been completed, but they are empty. 130 units are located as shells. Continue uphill numerous buildings can be seen standing as empty shells, and behind it lies a vast area which, although developed with district roads, however, have no construction work on it.

The big plans

The promoters of the project had done two years ago advertising: So they campaigned in the low-cost airline Easyjet in-flight magazine with full-page advertisements for the "Finca Parcs - Las Higuericas." When completed, they said the village should include more than 600 residential units. The planned investment volume has been prepared by English company Cleyton-Ges never been accurately quantified, but it would have amounted to about 100 million francs.

The target audience were mainly British pensioners, who wanted the sunny Spain to spend their old age - away from the tourist centers. Located in the middle of an untouched landscape in the Spanish province of Castilla-La Mancha - 120 kilometers from the nearest beach - the promoters of the development wanted to sell the "real Spain". In the village, it should want for nothing: The plan foresaw shops, restaurants and sports facilities in Finca Parcs.

How many buyers have been harmed by this fiasco, is unclear. The Promotor, the British company Cleyton-Ges, has never informed about how many housing units had been sold. Since the halt of construction work the company does not answer any more questions.

Blue-eyed politicians

In Spain, there are countless superstructures, which have not been finalized because of the financial crisis. Virtually all are located in the suburbs of the big cities or tourist destinations. But in almost any no other project that has comes to an economic loss is there such a destruction of the landscape. It is still unclear whether the work can be resumed at some point or whether the matter a dismantling.

The whole affair also sheds a bad light on the city authorities of Hellin. The socialist-dominated city government hoped that the project would be an economic boost to the region. For this reason, they createed this area, however, without obtaining the approval of the provincial government. Currently, however, it does not look like it, that would have the approval of this project, a legal aftermath.

Paradoxically, it was the People's Party, which is the economic development of the country a major concern that fought the project. Emilio Sanchez, a reporter at the local regional newspaper La Verdad, "says that the Promotor Cleyton-Ges in the early phase of the project's issued payments in excess of CHF 200,000 to the local clubs and groups to secure support for the project.

Dos juzgados ordenan embargar a la promotora de Las Higuericas

La empresa carece de sede, ha desactivado su web y los jueces la consideran «en paradero desconocido»

Una serie de clientes británicos han formado un grupo para seguir la evolución de la frustrada urbanización de Las Higuericas, en Hellín. Tras unos meses de nervios e incertidumbre, desde que la empresa Cleyton Ges les comunicó su decisión de devolver el dinero invertido, visto lo inviable del proyecto tal como se había planteado, ahora el nerviosismo ha aumentado al comprobar que incluso la página web de la empresa (que ya había dejado su sede física) ha desaparecido.

El 'Finca Parcs Action Group' denuncia que la web de Finca Parcs, que llevaba ya varios meses sin renovarse, ha dejado de estar operativa. Pero esto no es lo más grave, ya que denuncian que no se han cumplido los compromisos, publicados en septiembre, de devolver la inversión y los intereses legales a los compradores.

A pesar de sus gestiones, aseguran que «todavía no tenemos ninguna evidencia tangible que sugiera que el proceso de devolución [del dinero invertido] es auténtico».

La clave de los debates (que ha provocado un intenso cruce de notas y comentarios en los foros de inversores internacionales) está en el hecho de que sólo una parte de las casas vendidas se compraron con garantía bancaria de la CAM. Y aunque la empresa promotora aseguró que tenía provisión de fondos para devolver su inversión también a los clientes sin garantía bancaria, los afectados exponen que siguen sin recibir su devolución, y se sienten víctimas de «seis años de promesas rotas, falsas esperanzas y comunicados incorrectos».

Más problemas

El nerviosismo de los clientes tiene otro motivo de inquietud en los últimos días con las decisiones judiciales de embargar bienes a Cleyton Ges que se han producido en Albacete y Murcia. Los juzgados de lo social número 2 de Albacete, y número 5 de Murcia han atendido la petición de ex empleados de esta compañía de ejecución mediante apremio, por lo que han acordado el embargo de bienes.

Tanto en estas resoluciones como en otros requerimientos publicados por servicios de recaudación y de la Seguridad Social se cita a Cleyton Ges en situación de «ignorado paradero», ya que se desconoce su localización actual.

Mientras clientes, recaudadores y jueces tienen problemas para localizar a la empresa, las obras de lo que iban a ser más de 600 chalets siguen paralizadas desde hace meses. Sólo una de las fases está prácticamente acabada, pero con serios problemas judiciales, ya que el juzgado anuló las licencias concedidas, y hay pendientes al menos un recurso y otras dos demandas de Ecologistas en Acción

The key to the debate (which has provoked an intense exchange of notes and comments in the forums of international investors) is that only some of the homes sold were issued with the Bank Guarantee of CAM Bank. And while the development company said it had provision for its investment return also to customers without bank guarantee, the affected group still have not received a refund, and they feel victims of "six years of broken promises, false hopes and inaccurate statements '.

More problems

The nervous customers have another concern because in recent days there have been judicial decisions in Albacete and Murcia against Cleyton GES to seize assets. The Social Court No. 2 of Albacete and Court No. 5 in Murcia have heeded the request of former employees of this company, and have agreed to the confiscation of property.
 
Both in these court resolutions and in other published documents for collection services and Social Security payments it is quoted as Cleyton GES 'whereabouts unknown' because their current location is unknown.
 
As customers, debt collectors, and judges have trouble locating the company, the works of what would be more than 600 houses have remained paralyzed for months. La promotora difunde una nota en la que considera inviable la urbanización Está comenzando el proceso para devolver a los inversores sus aportaciones

La macrourbanización de Las Higuericas, en Hellín, es «inviable». Esta vez no lo dicen los ecologistas, la oposición hellinera o el sentido común. Ahora lo reconoce la propia promotora, Cleyton Ges, en un comunicado remitido el día 21 a los compradores, en el que también se compromete a devolver los pagos realizados por los clientes. 

Mientras tanto, en este lluvioso otoño, la urbanización ofrece un aspecto desierto y penoso: algunas casas acabadas pero vacías; otras a medio hacer, desmontes y terraplenes que empiezan a desmoronarse y un aire de abandono y desolación.

El comunicado llega tras un verano muy caliente en la comunidad de los clientes de esta promoción, en su mayoría inversores de Gran Bretaña. Mensajes alarmados, rumores, búsqueda de abogados e intentos, la mayoría fallidos, de encontrar interlocutores que aclarasen la situación.

La página web de Finca Parcs no ha renovado sus contenidos desde diciembre del año pasado; los teléfonos de la empresa no responden (un mensaje de Telefónica asegura que no hay ningún abonado con ellos); algunos clientes aseguran que la sede de la firma también está vacía.

Suspensión

Tampoco la página web de la empresa de mantenimiento (Fincavalleyspain) ofrece ninguna información. Al contrario, un correo electrónico enviado desde su dirección aseguraba a los inversores, el 10 de agosto, que suspendía todos sus servicios y comunicaciones hasta nuevo aviso.

La única forma de contacto efectivo que se ofrece es un teléfono móvil y un correo electrónico de Hotmail encargados de gestionar la información sobre las devoluciones. La persona que lo atiende explicó que no tiene autorización para dar ningún dato, y tampoco pudo ofrecer otro medio de conectar con algún responsable de la empresa.

El comunicado de Cleyton Ges indica que el proyecto de Las Higuericas Finca Parcs ha resultado financieramente inviable («has become financially unviable») a causa de la actual crisis global, pero que en cualquier caso es intención de la empresa devolver todos los pagos, incluyendo los intereses legales, a los clientes que tenían propiedades reservadas.

La empresa asegura que se pondrá en contacto con los clientes que le compraron directamente. Al resto, según los casos, anuncia que, o bien si han firmado la cancelación y tenían garantías de la CAM recibirán instrucciones de la entidad financiera para gestionar la devolución; o bien, para los clientes que no han recibido su aval bancario, se les informará del procedimiento para obtener el dinero, incluido un 6% de interés entre la fecha de reserva y la de vencimiento.

En sucesivas comunicaciones, se asegura que también a los clientes sin aval bancario se les devolverá la inversión, y se les anuncian futuras instrucciones para concretar el modo de hacerlo.

Hace unos meses, en marzo de este año, tanto el concejal hellinero Ramón García, como Ramón Ramiro, por parte de Cleyton Ges, aseguraban que la promoción seguía en marcha, pendiente sólo de resolver algunas cuestiones relacionadas con las licencias, con una primera fase terminada y una segunda avanzada.

La empresa indicaba que tenía vendidas más de 400 viviendas de las más de seiscientas proyectadas. Sigue en el juzgado el recurso a la sentencia que, en noviembre del 2008, anulaba la licencia municipal para construir las primeras 105 casas. Antes se había sobreseído otra denuncia, de los ecologistas, contra esta misma urbanización.

Reclamaciones

Las reclamaciones ya han empezado; abogados españoles especializados en clientes de habla inglesa han confirmando que están gestionando devoluciones (en principio, del avalista bancario, la CAM) de personas que invirtieron en las primeras fases de esta urbanización. En los foros ingleses otros afirman que han llevado el asunto a sus lawyers.

Otras fuentes aseguran que empresas que han participado en las obras de construcción plantean la reclamación de los pagos pendientes, incluyendo la petición del eventual embargo de la finca.

Finalmente, algunos clientes que tenían aval bancario aseguran en los foros ingleses que sí han conseguido gestionar la devolución, y que ya han recibido su dinero, incluyendo los intereses legales; han sido los primeros.

Suspension

Neither the website of the management company (Finca Valley Spain) provides any information. Instead, an email sent from their address advised the investors, on 10 August, that they had suspended all its services and communications until further notice.

The only effective form of contact that is now offered is a mobile phone and an email from Hotmail responsible for managing the information on refunds. The person on the mobile phone explained that they are not authorized to give any information, nor could offer another means of communicating with owners of the company.

Cleyton GES statement indicates that the Finca Parcs Las Higuericas development has proved financially unviable ("has become financially unviable") because of the current global crisis, but in any case the intention of the company is to refund all payments, including statutory interest, to customers who have reserved properties.

The company says that it will contact customers who purchased directly. The rest, as the case announced that, or if they have signed the cancellation and had assurances from the CAM receive instructions from the financial institution to manage the return, or, for customers who have not received their bank guarantee, are inform the procedure for obtaining the money, including a 6% interest from the reservation date until the maturity date.

In subsequent communications, it also ensures that customers without bank guarantee investment will be refunded, and they will announce further instructions to finalize the procedure.

A few months ago, in March this year, both the Hellin Councillor Ramon Garcia, and Ramon Ramiro Mauleon of Cleyton GES, assured us that the promotion was still running and that they had only to resolve some outstanding issues relating to licensing, with the first phase completed and a second phase well advanced.

The company indicated that it had sold more than 400 houses of the 600 and were in court to appeal the sentence in November 2008, which annulled the municipal license to build the first 105 houses on Phase 1. Previously another complaint had been dismissed from environmentalists against this same development.

Claims

Complaints have already begun; Spanish lawyers specializing in English-speaking customers have confirmed they are managing refunds (in principle, the guarantor bank, CAM) of people who invested in the early stages of this development. In other English forums clients claim to have brought the matter to its lawyers.

Other sources say that companies that participated in the construction have raised the claim of outstanding payments, including the submission of any seizure of the property.

Finally, some English customers in the forums who say they had a Bank Guarantee have already successfully managed to receive a refund including statutory interest from the bank.
