The amount of 1,494,710€, which
is the principal amount of the deposits claimed will be transferred to

September 2012 when the Court re-opens after the summer break. The
interest and costs will
remain with the Court until the case is finally resolved

Europe at the Foreign & Commonwealth Office in London to discuss the
Finca Parcs issue and the wider
Bank Guarantees situation.
8 September 2011 - Enrique Ros - the Manager of Lauara
Europea SL holds a meeting with Hellin Town Planning Officer - Jesús Tébar. Enrique Ros states to
La Verdad Newspaper:
"Our position will be to try to speed up the process, because there are
many families waiting to enter"
7 September 2011 - On behalf of Cleyton GES SL, Pedro Antonio
Jimenez Peñalver, presents a letter to
Hellin Town Hall. The letter urges the Town Hall to recognise the
agreement between Cleyton GES SL and
Lauara Europea SL which was signed on 7 July 2011.
6 September 2011 - Pedro Antonio Jimenez Peñalver who became
Administrador Unico of Cleyton GES SL on 16 December 2009, states on 6 September 2011 to La Verdad
newspaper:
"I have invested everything in this and I want to meet those who have
bought a house"
6 September 2011 - Lauara Europea SL attempted to take
possession of the works at Las Higuericas,
Finca Parcs. Security Guards employed by Caja de Ahorros del
Mediterráneo (CAM Bank) and Alianza Zero prevent workers and officials of Lauara Europea SL and
Cleyton GES SL including Pedro Antonio Jimenez Peñalver
and Enrique Ros from entering the gates to the urbanization.
1 September 2011 - Lauara Europea SL submits a statement to
Hellín Town Hall which requests the substitution
of the obligation for the completion of the work at Las Higuericas Finca
Parcs. The statement requests that
the Town Hall accepts the contract signed between Cleyton GES SL and
Lauara Europea SL on 7 July 2011.
23 July 2011 - Banco de España takes control of Caja
de Ahorros del Mediterráneo
12 July 2011 - On behalf of FINCA
PARCS ACTION GROUP members Keith Rule visits the Las Higuericas,
Finca Parcs site to analyze the current situation. The site is
still like a ghost town and in exactly the same condition
as it was left in May 2009 when it was abandoned by Cleyton GES SL.
Photos are taken as evidence.
7 July 2011 - Cleyton GES SL (Pedro
Antonio Jimenez Peñalver) signs an agreement with Lauara Europea SL.
This agreement states that Lauara Europea SL (Enrique Ros) assumes all
obligations of Cleyton GES SL and at
its own risk is now responsible for all the remaining work to complete
the project.

LAWSUIT 1 - Defence files submitted to the court by Cleyton

June 2011 - Caja de Ahorros del Mediterráneo failing to
honour legitimate Bank Guarantees held by some
members of the group. Individual Executive Lawsuits now being prepared for these group
members in
an effort to force CAM to allow the legitimate execution of the Bank
Guarantees.
4 May 2011 - Keith Rule & Reg Matthews from FINCA
PARCS ACTION GROUP stage protest against the
Spanish Government Property Road Show outside the Spanish Embassy in
London. Finally granted a meeting
with Spanish Government officials to discuss the Finca Parcs situation
and the wider Bank Guarantee situation.
April 2011-
LAWSUIT 2 - Second Lawsuit being prepared for
remaining group members (12) who
have not received the
legally required Bank Guarantees.
31 March 2011 - Caja de Ahorros del Mediterráneo the funding
entity of Las Higuericas Finca Parcs goes to
the Banco de España for funding after the proposed merger with 3 other
smaller CAJA's fails. It is possible that
the Spanish Government and Banco de España will take a 50% stake in CAM.

25 November 2010 - Significant new CASE
LAW from The Appeal Court in Santander relating to a case
on a different development where the purchaser only received a Bank
Guarantee for part of their deposit payment. The court ruled that the Bank was liable for
the repayment of the whole deposit and not just the
amount they had chosen to issue a Bank Guarantee for.
October 2010 - Keith Rule Coordinator of FINCA PARCS
ACTION GROUP 'locates' Bank Guarantees for
5 members of the group. These group members did not know of the
existence of Bank Guarantees in their
names. The process of executing those Bank Guarantees now begins
with CAM.
October 2010 - Lawsuit against Caja de Ahorros del
Mediterráneo being prepared for submission
to the court via the Procurador.
14 October 2010 - Significant new CASE LAW obtained stating
liability of a Bank for off-plan deposits

April 2010 - The FINCA PARCS
ACTION GROUP has since November 2008 been in regular contact with
Antonio Hernandez Gomis in an effort to secure refunds for the whole
group. Despite numerous promises
Antonio Hernandez Gomis failed to refund any purchaser. It now
appears that Antonio Hernandez Gomis has
signed Cleyton GES SL over to Pedro Antonio (J)Gimenez Peñalver
who was appointed as the Administrador
Unico on 16 December 2009.
